A quick intro…

Boo! Marketing provides a range of marketing support with a focus on marketing strategy, planning, results reviews, monthly support, coaching and mentoring. 

We’re a team of long-standing professionals with bags of experience and qualifications. Whilst we absolutely know our stuff, we don’t know everything, so if we’re not the best people for the job, we’ll let you know. 

We love marketing and putting you, the customer, first. We always aim to be helpful and flexible. And, like you, we don’t just work with anyone. It’s got to be a win win for both sides. We only work with those that are:

  • passionate about people and how they help others 
  • a joy to work with
  • all about long-term relationships and team working
  • after knowledgeable marketing professionals 

We take the time to understand the people in your business, as well as the business itself, this way we can fully meet expectations using our 26 years of experience, always applying respect and confidentiality.

To get our working relationships off to the best possible start this agreement helps manage expectations. And, as we’re about keeping things simple, we carry this through here in a way that’s easy to understand and in plain English. 

The bog-standard stuff

Business hours: Monday to Friday, 9am to 5pm. If you need support outside of business hours there’s an additional 50% fee required, which must be agreed in advance of the services being provided. 

We make ourselves as accessible as possible – email is the main communication channel. We’re available for phone calls during office hours only. Feel free to message/leave voice messages outside of these times for a response within 1 working day. 

We’ll add you to our newsletter to keep you updated – you can unsubscribe at any time (but bear in mind this is how we keep you updated).

Fixed costs – we aim to work on a fixed costs basis as much as possible to keep fees transparent, so you know exactly where you are up to.

Work is booked and paid in advance – this way we can give you our full attention, and make sure you get what you need, when you need it. Whilst we are flexible, changes to agreed works may impact the timings. If work has already been approved and changes are required there will be an associated cost. 

Work/Time booked and paid in advance cannot be carried over or refunded as time has been set aside for you.

Ad hoc requests and hourly support – we can’t guarantee ad hoc requests and will always try our best to meet your needs. 

Advertising – all advertising costs are covered by the client.

Deposits – to secure time and start work on individual projects we require a 50% deposit with the remaining balance due on completion, unless otherwise agreed.

Timings – we believe in hitting deadlines every time. We can only do this with you playing your part and can’t be responsible for a missed deadline due to late payments, materials requirements, or feedback. 

Cancelling this agreement – to cancel this agreement, you may be required to make an additional payment to cover work we’ve done and agreed. The standard notice period for cancelling is one calendar month.  

Working together must be a 2-way thing

Bigger picture – you understand that marketing is about seeing the bigger picture as part of a wider marketing strategy and plan that works towards your business goals. You understand that marketing is something that must be on all the time, turning it up and down when you need to. It can be a slow burn (depending on resources). Usually within the first 3 months you’ll see results.

Know that we’re experts and we care – we know what we’re doing (you’ve seen the reviews and soon you’ll see the results! The first few months can be uncomfortable, we’re all learning, eventually you’ll be super happy and glad you took the journey with us.

Provide us with everything we need – project/work briefs, content, photos, product images, logo/brand, font types, colour palette etc. If you could also make sure source material is clear and legible, as Boo! Marketing cannot be responsible for the quality of inputs supplied or permissions for use. We can provide royalty free images (unless otherwise agreed/supplied) and cannot be held responsible for any related usage issues

We provide 2 rounds of amends on all our work – further changes, beyond the 2 rounds of amends, will obviously take extra time. We can agree deadlines and costs for those together, and will do everything we can to meet your needs  

Review work within 2 days – if you could give us written feedback, and approval/sign-off within the agreed timings it makes everything run quickly and smoothly to keep momentum going while everything is fresh in our minds. 

Understand how we charge and pay on time – we’re a small business that prides ourselves on providing services to a high standard at accessible prices. With that in mind we ask that you pay invoices on time. If invoices aren’t paid on time your account is put on hold and interest is automatically applied (sorry, it’s not personal!)

Be considerate of time – it’s important we’re working on getting you results. Occasional telephone calls of few minutes don’t bother us. Calls of 10 minutes or more will automatically be billed. 

Be kind – it’s important for us all to work with lovely people that are a joy to work with. We like to keep the energy positive, and action focused.

Meetings are agreed and scheduled in advance – cancellation of meetings requires a minimum of 48 hours advance notice from both parties (where possible). Missed meetings or cancellations without sufficient notice are charged at the agreed fee. 

Travel – costs, tickets and time taken are billable, including mileage, parking, accommodation, and transportation fares. All pre-arranged/pre-booked travel arrangements are payable in full by the customer, if costs have been incurred and the customer chooses to cancel any arrangements.

Materials, information & copyright – copyright of the work Boo! Marketing produce remains our property until all fees are paid. Once fees are paid you can then use the work as you wish. Please note, we don’t share artwork files due to the time involved in managing this and storage space. If you do require artwork files a fee may be applicable.

A bit of flexibility – you might receive the odd communication from us outside of business hours. We’ll do all we can to respect that work-life balance that we all need though.

We’re all human – mistakes can happen that are out of our control, we’ll always do all we can to help. And we can’t be responsible for deadlines missed due to circumstances completely beyond our control, like family emergencies, floods, war, acts of God and anything else along these lines. Blah, blah, blah.

We love to show off our work – and will use your projects for our portfolio, which will also support your Google rankings, creating a win win for both sides. If you do not want us to do this, or use your branding, images, graphics, or analytics, including (but not limited to) press releases, social media, case studies and websites, please do let us know.

That little thing called money

Payment is via bank transfer within 7 days unless otherwise agreed to:

Great communication is key to a positive and long-term working relationships. Do let us know of any queries and/or process requirements to make sure there’s no awkward situations that take up unnecessary time on either side. We’re as flexible as you need us to be.

If an invoice is unpaid by the due date, your account will go on hold and daily interest will be automatically applied. Materials or property belonging to the customer will be retained as security. 

Yuk! Interest and charges – we’d rather not go there as the daily rate of accruable interest on late payments is 8% as per the Bank of England’s base lending rate. The customer will pay the interest immediately on demand. Fees for time covered in pursue of late fees will also be applied at the rate of £60 per hour. In the event of collection enforcement, you’ll be liable for any associated costs, including, but not limited to, legal costs, courts costs, and collection agency fees.

GDPR thing-a-ma-jig

Both parties agree they are compliant under the General Data Protection Regulation, (GDPR) (EU) 2016/679. Each party will notify the other, in a timely manner, if there is a data breach that involves the other’s data.

If required for and on behalf of the customer, Boo! Marketing will use the following data throughout the duration of this work/agreement:

Email address, postal address, phone numbers. 

One last thing – the legal stuff

We always do our best to make sure work is error-free and provide you with up to 2 rounds of amends to make sure you are happy, we therefore can’t be liable to you or any third-party for damages, including lost profits, lost savings, litigation, or other incidental, consequential, or special damages. If any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

Make sure you’re completely happy with this agreement and our work together, that way we’re not making changes that’ll create extra work and take up more time for either side. We wouldn’t want to be starting work for this then to be changed, as it can impact the costs agreed.

Although this agreement is simple, we go by the intentions and our customers accept them. This contract is a legal document under exclusive jurisdiction of English courts.

Few! Now that’s all done with and we’re all in agreement. Make sure you keep a copy of this document for your records, and we very much look forward to working with you.
